Terms of Service

This document constitutes a binding and complete agreement between SmtpMac Inc. and you regarding the use of our platform services. Last revised: December 7, 2025

1 Acceptance of Terms

This document (the "Agreement") is a legally binding agreement between you (the "User" or "you") and SmtpMac Inc. (the "Platform" or "we") governing your use of the Mac cloud hosting and related features (the "Services") provided by this platform. Please read all terms carefully before using the Services, paying particular attention to the disclaimers and restrictions.

By clicking "Agree", "Get Started", or any similar button, or by using the Services in any manner, you confirm that you have fully read and unconditionally accepted all terms of this Agreement. If you disagree with any provision, you must immediately stop using the Services.

2 Services & Changes

2.1 Core Services

This platform provides cloud computing resources based on Apple Mac hardware. We reserve the right to modify the scope, features, technical specifications, or delivery format of our services at any time based on business needs.

2.2 Availability

While we continuously strive to provide a stable and reliable service experience, we do not guarantee uninterrupted or error-free operation. You acknowledge that factors including but not limited to network fluctuations, hardware wear, and system maintenance may cause temporary unavailability. Our liability in such cases is limited to the applicable Service Level Agreement (SLA).

2.3 Third-Party Features

Our services may integrate or reference products and features provided by third-party vendors. We make no express or implied warranties regarding such third-party services and bear no responsibility for them.

3 Account Rules

3.1 Accurate Information

You warrant that all information provided during registration and subsequent use is truthful, accurate, complete, and kept up to date. You bear full responsibility for any consequences arising from false information or failure to update your details.

3.2 Credential Security

You are responsible for safeguarding all account credentials, including but not limited to your username, password, and SSH keys.

All actions taken using your account credentials are deemed your own. You bear all legal liability for any resulting consequences. If you detect any unusual activity or unauthorized access to your account, please contact us immediately.

4 Billing Policy

4.1 Payment

This platform operates on a prepaid basis; full payment must be completed before service activation. All fees are quoted in US Dollars (USD) and exclude taxes. Any tax obligations arising from use of the Services are your sole responsibility to declare and pay.

4.2 Refunds

Except as required by applicable law, all payments are non-refundable, including account balances and purchased but unused subscription time. The platform reserves the right of final interpretation of this policy.

4.3 Price Changes

We reserve the right to revise service pricing at any time. Price changes will be communicated in advance via in-platform announcements or user notifications. Renewals are billed at the current rate at the time of renewal.

5 Acceptable Use

You agree to comply with all applicable laws and regulations while using our Services, and must not engage in any of the following prohibited activities:

  • Violating applicable national or regional laws, regulations, or regulatory requirements;
  • Infringing on the intellectual property, privacy, or other legal rights of others;
  • Sending spam, engaging in phishing, or conducting other fraudulent activities;
  • Conducting unauthorized port scans, network attacks, or distributing malicious code or viruses;
  • Mining virtual or cryptocurrency (except with our prior written permission);
  • Abusing platform resources or disrupting other users' normal use of the Services.
If we discover any violation of the above, we reserve the right to immediately suspend or terminate service, delete related data without a refund, and without prior notice, while retaining the right to pursue legal liability.

6 Data Handling

6.1 Data Ownership

Data stored on our servers belongs to you. We make no claims of any kind over your data content.

6.2 Backup Responsibility

You are solely responsible for backing up and securing your data. Any backup features provided by the platform are supplementary tools only and do not constitute a guarantee of data integrity or security. We are not liable for any data loss, corruption, or leakage caused by equipment failure, software vulnerabilities, user error, or any other reason.

6.3 Privacy

You agree that the platform may collect, store, and use your personal information in accordance with our Privacy Policy.

7 Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied.

To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will fully meet your business needs, operate without interruption, respond promptly, or be free from errors.

8 Liability Cap

Under no circumstances shall the platform, its affiliates, directors, employees, or business partners be liable for any indirect, incidental, punitive, consequential, special, or exemplary damages (including but not limited to loss of profits, data, or business interruption), even if we have been advised of the possibility of such damages.

To the extent permitted by law, our total aggregate liability to you (whether based on contract, tort, or any other legal basis) shall not exceed the total service fees you actually paid to us in the one month preceding the claim.

9 Termination

9.1 User Termination

You may stop using the Services at any time, but fees already paid are non-refundable.

9.2 Platform Termination

If we have reasonable grounds to believe you have violated any provision of this Agreement, we may suspend or terminate your service at any time without liability. Upon termination, we reserve the right to immediately delete all data stored on the platform by you.

10 General Terms

10.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where SmtpMac is incorporated. Any disputes arising from this Agreement shall be submitted to the courts of competent jurisdiction at the company's place of incorporation.

10.2 Severability

If any provision of this Agreement is found to be unlawful, invalid, or unenforceable, it shall be treated as severable and shall not affect the validity or enforceability of the remaining provisions.

10.3 Entire Agreement

This Agreement constitutes the entire understanding between the parties regarding the Services and supersedes all prior written or oral agreements and representations.
